TUPE and Pre-pack administration

Employers buying an insolvent businesss who think they may be safe against claims from employees dismissed by the administrator need to take urgent advice on TUPE issues.  The Employment Appeals Tribunal, changing direction from previous caselaw, its decision in OTG Ltd v Barke suggests that in pre-pack administration situation, employees employed immediately before the transfer will have their employment transferred to the purchasing business.
